Hon Richard Yates Dear sir

Yours of the 7th in reply to mine of 28th May was received by me upon my return a day or two sinse from Shawneetown. The defeat of Marshall for Congress will render it unnecessary for an Executive appointment to fill the Office of Judge of this circuit. Besides I think the new Constitution is defeated and if so there will be no vacancy in any event. I am however under many obligations to you for your kind inten- tions in the matter There are many prominant Democrats of this part of the State who have been opposing the new Constitution in other counties But in this county they all worked together in favor of it. The vote stands as follows in this county for new Constitution 1088 against " 545
