Dear Sir:

When I got home, Wednesday 23rd Decr. I found your letter in relation to the report that Mr. Beckwith was to be appointed. The report grew out of no promise or even intimation from me, but from the fact that Judge Caton would resign only upon condition of Mr. Beckwith's appointment. Judge Caton wrote me of date New York Decem 16th, 1863 that he declined any intention to dictate, but that he would give me the opportunity of appointing Mr Beckwith by his resignation tc. I determined to say nothing to any one until I could see Judge Caton in person. I saw the Judge to day-- I found him determined to hold on to the office unless Beckwith was appointed. He said he could not do otherwise -- he felt compelled to hold on unto to the end unless Mr B. was appointed - that such was the only way he could make the resignation satisfactory to his friends, tc After full consultation with our best friends, and the best consideration I could give the subject, I thought it best to accept Catons resignation and give the appointment to Beckwith. I do not want you to feel bad towards me in this matter because I saw I could not get the chance to appoint you -- my refusal to appoint Beckwith would do you no good-- Our friends prefer Beckwith to Caton and have now hope of fairness at his hands. I have only to hope for some opportunity hereafter in some way to show my high appreciation of the great kindness assistance I have received at your hands. Your friend
