March 19th 1862.

To His Excellency Gov Yates,

Mr. McBane of Massac County has called on me requesting me to recommend him to you for the appointment of Pros Atty in the district in which a vacancy occurs by the death of the gallant Col Smith. I beg leave to say that I am wholly unacquainted with the people and the bar of the District and know nothing of the persons from whom your Excellency may select an appointee except Mr. McBane.

While I was stationed at Metropolis I made his acquaintance and found him to be an agreeable gentleman of fine manners and appearance. He is a graduate of the Law School at Louisville has practised law for two years and from his general attainments and information I should infer that he is qualified for the position.
