You are again honored with a position,- which may not only be exceedingly gratifying as a full endorsement of the acts of Your gubenatorial administration in the most novel, critical & trying period of our history - but one that will enable you to exert a great influence in extricating the public affairs from their abnormal conditions and wisely placing them under a politicians system of reconstruction - permanent as time, and calculated to restore harmony to the sections - union & brotherly love among the masses with peace to the whole country. May God endow you with wisdom and grace in devising right measures, & administering

Granting you will pardon the liberty I have taken on this addressing you. It's a favor I would ask, not for myself and yet one which indirectly will please me far more than anything I could ask for myself. [Illegible] through your influence and power you can grant my request: My Father the Editor of the "Union" has worked hard for you and by your successful election. Will you not in some manner help him? The paper is not only self sustaining and cannot soon receive assistance from another source. The Post Office should belong or with the [familiarity?] office and yet he would never ask you for it on account of the enemies it would make for him. The [illegible] politicians of R. I. are

of very little account. Father was very much surprised and indignant at the way Senator Webster cast his vote, having previously promised Father to vote for you, which he was honest enough in untill bought [illegible] by Mr. Washburne. It can however make no difference to you now. But I am digressing from my subject.

You will please not let my Father knows of this note it might displease him very much with me. I have only called you attention so that should it be your wish you might be of great assistance to him.

Trusting you will pardon the entrusion I have made upon you

I am respectfully

Dear Sir:

Ottawa Jan 6th 1865.

Gov Yates -

My dear Sir.

I was so rejoiced at our triumph in your successful candidacy for the Senatorship, that I almost forgot the clouds which have again gathers around my own hearth-stone.

I have begged Mr Bushnell to hand you this, and to ask your yet further protection for me and mine. Some enemy has finally prevailed against us, and Gen Schofield has resorted to the unusual step of reversing the Decision of his own Judge Advocate Genl whose decisions at Washington, I have been told by persons officially informed, are considered and highly respected, as those of a talented and conscientious officer. I enclose his Decision, to Mr Bushnell, who will show it to you.

My husband is so amazed and indignant that he leaves all action to me. I shall appeal to the President. I beg your help. O Gov Yates! - you have been a friend to me through all this sore trial - and now, in the hour of your hightest and most deserved triumph, I feel sure you will not forget me when I cry to you, as I do, from the depths of an aginized heart. I ask you to write to the President asking his interposition, and to forward the letter to me. Judge Norton will present them and be my advocate. And I beg, I entreat you to care for my distress, and to do anything else not suggested by me.

which your wisdom may make you think of, and my ignorance may overlook. I cannot, I will not submit to this injustice without doing all in my power to evert it. I shall beseige you - and the President - and Heaven itself. I cannot I will not have it so help me! - do not get tired of me! prays

yours truly and respectfully

Sarah E. Henshaw

As I write I gather courage, and conclude to send you the Decision direct. May I beg you to examine it closely, and to remember that although it was as you will see addressed to Capt Curtis, it never reached him until he found it by accident in the office of some official - and when it did come to him, which was only five days ago, it came in the form of an order made out - signed by Gen Schofield - and adverse to us. Captis Curtiss himself informs me of these facts, and writes to prepare me for the worst he being a friend of my husband's. There has been a fraud somewhere.

And I beg, I entreat you to have any new Commissions for the Lieutenants of the Battery prevented, until we have time to hear from the President.

Please notice that Maj Burnett says the sentence of the Court cannon legally be carried out. How can it then be done?

Henshaw Sarah E

Ottawa Jan 6 65

Congratulats you on Election to the Senate & pray you to help her

Hon Richd Yates.

Ottawa Jan 6 65

Endorsement on Proceedings of a G. C. M. convened at Knoxville Town May 10th 1864. In case of Capt. E. C. Henshaw, Henshaw's Indpt Battery of Lt Arty Ill Vols. Ford with endorsement of Brig Genl of J Ammen Sept 3/64.

Judge Advocate's Office D.O. and N.D.

Cin. O Sept. 21st 1864

Respectfully returned to Capt Henry Curtis Jr

A.A.G. D.O. Knoxville Tenn.

As the case now stands, the sentence passed by the court cannot legally be carried into execution by the Department Commander, for the reason that a portion of the findings of guilty by the Court and which must reasonably be supposed to have had their influence upon the minds of the Court, in making up the sentence passed, have been disapproved by the officer ordering the Court, while the sentence is approved.

It is by no means certain that the sentence as passed is, as it would have been, had the accused been found not guilty, of the 3rd Specification of 3rd charge and 6th charge and its specifications. Hence the impropriety of disapproving the findings and at the same time approving of the Sentence passed as the deliberate judgment of the Court upon those findings.

Aside from this, a careful examination of the proceedings seems to one clearly to indicate more of desire on the part of the Lieutenants who appear as prosecuting witnesses to advance their own interests that those of the Government by the removal of the accused, who appears to have managed his Company affairs, with as much or more ability, and as great regard, for the interests of the service, as the vast majority of officers in the army.

While hardly a specification in all the long list of charges, has, to my mind, been clearly proved, the evidence nevertheless shows the accused to have been guilty of some irregularities that probably deserve censure, but nothing that would warrant the carrying into execution of the sentence passed.

The accumulation of charges is probably one of the worst features in the case. This is, and always has been considered detrimental to the interests of the public service and good of the army.

I have therefore to recommend that the proceedings be disapproved and the accused restored to his command, believing as I do the present trial, will be a sufficient warning to the accused to avoid even the appearance of wrong doing, and the disapproval of these proceedings, restore to the Army an Officer who

has proved himself a gallant one on many a hard-fought field.

(Signed) H. L. Burnett
