</p><p>Will you favor me with your attention to a very important matter.
</p><p>It is the unanimous wish that the State should get the 15 perct. deduction on her quota of the Direct tax provided for by the Act of Congress Aug 6,1861, and that the tax should not be collected by the U. State directly. An examination of the 3rd Sec. of the Act satisfied me that the Governor could not decide the mode in which the State would pay her quota - whether by set off - whether by paying directly – or whether by assessing and collecting or other mode without action by the Legislature. Yet being much averse to a call session, I came to the conclusion above very reluctantly, and got Mr Butter,

<p>(who is also very averse to a call session) to see Judge Logan, and get his written opinion. Judge Logan, after full examination, informs me that he is very clear that a call Session is necessary – As soon as he furnishes me his opinion in writing I will send you a copy, but I may not get it soon. Now, as to time for the Call Session – the Governor, under the law of Congress for raising the tax, is required to give notice to Sec. Of Treasury of the intention “to assume and pay or to assess, collect & pay” on or before the 2nd Tuesday of February, 1862 - There is sufficient time to give the notice for a call Secession & have it before February, but it would conflict with the Convention which begins first Monday in January.
</p><p>What I desire you especially to attend to for me is this: to ascertain whether the Sec. of the Treasury will consider a notice of the intention to assume & pay by the Governor sufficient.
</p>

<p>without any previous legislature sanction. Second whether notice cannot be given by the Governor, and the call session holder after the 2nd Tuesday in February to determine the mode in which the State will pay the tax.
</p><p>Also to suggest that as sessins of the Legislature are very expensive and would in consequence to a good degree deprive the State of the saving of the 15 percent, whether some amendatory law should not pass requiring the Governor in a State having no regular session to decide the matter.
</p><p>In a word, I desire your assistance with the Treasury department in the premises, and your views in relation tot the whole subject matter at the very earliest date practicable, and shall be very much obliged to you.

</p><p>To the Governor of the State of Illinois
</p><p>Mr. Yates:
</p><p>My brother Marcus B. Willard, on the 9th of last May, enlisted in the 16th Illinois regiment. Since that time we have heard from him directly but once. and his friends in this vicinity are very anxious on this account.
</p><p>What I wish to know is if that regiment was only organized for three months, and if so, was it reorganized at the expiration of that time, under the same colonel. I would like, also, to ascertain the killed sick and wounded of that regiment. We of Wisconsin can learn the particulars with regard to our own state's regiments, but find it difficult to ascertain the whereabouts of others. We have searched the papers, and have traced the 16th as far as the battle of Lexington, and have seen nothing farther about it.
</p><p>You see what we need. Will you please inform us in what we wish to know, or direct us, so that we may gain such information, in doing which you will receive the sincere gratitude of Brother's friends.

</p><p>Every day Satisfies me more and more that unless you take hold of the questions that relate to and intimately concern the honor and even the lives of our troops the lives of half and the labors of all will be thrown away Just now we have a practical illustration of this. Several Illinois regiments and others amounting to above Eighteen thousand are put into Winter quarters here This is bad enough and sufficiently – illustrates the utter imbecility and folly of the whole system upon which the affairs of this Department are managed for if troops are needed here at all five thousand federal troops are more than sufficient
</p><p>But this is not the worst of this The first Division (ours) which includes the 14th 15 & 42 Ills two Indiana and one Missouri regiment are now ordered to prepare Winter quarters in a swamp a large part of which is under Water and I cannot march my men to it instead wading and when we drain it, we have to suffer from the malacious influence of large tracts of fresh drained swampland and when I lead my poor men into these quarters I shall bury many of them before spring and I say to you that no man of good sense or

<hr /> common humanity would require of us to go there And there is no volunteer Officer in the service that is stupid enough to do it Now with the prospect of having men die by Scores from the folly of this Indiana Colonel who comes from the Regular Army what shall I do
<p>In my opinion you [ought?] at once send an intelligent agent who has both sense and courage to visit these Illinois regiments before this needless but shameful sacrifice take place and then do what becomes the Chief Magistrate of a State which furnishes 80000 men to do If you do not feel at liberty to do this or something else effectual you ought in justice warn the people against entering a service so desperately managed
</p><p>Again more than ten days ago your Quarter Master packed and sent forward clothing for my regiment and indeed complete equipments and from the [unwillingness?] of the Officers at St Louis (as I believe that you should furnish us not one of these things have come to hand though many of my men are going about day after day in drawers alone not having a single pair of Pantaloons

</p><p>I believe I shall send the one I have to McClelland if you will send me the addendum of arms needed. To ascertain arms needed take the number of troops in camp - and state that when our agent Wolcott returns we will send him description of kind and quality of arms in the hands of soldiers in actual service.

</p><p>Learning that there are numerous incomplete companies at Camp Butler, it would be of great advantage to this Regiment and perhaps to the public service if the deficient companies of the regiment could be filled by assigning the men of the former (with a Lieutenant) to this Regiment. I want 240 men to fill my Regiment. Six companies have less than the minimum prescribed by law. If you can possibly send me some of these companies, or unassigned recruits, I will guarantee so far as lies within my province, a first or second Lieutenancy in the Regiment for every lot of 20 men or more.

</p><p>Learning that there are numerous incomplete companies at Camp Butler, it would be of great advantage to this Regiment and perhaps to the public service if the deficient companies of the regiment could be filled by assigning the men of the former (with a Lieutenant) to this Regiment. I want 240 men to fill my Regiment. Six companies have less than the minimum prescribed by law. If you can possibly send me some of these companies, or unassigned recruits, I will guarantee so far as lies within my province, a first or second Lieutenancy in the Regiment for every lot of 20 men or more.

</p><p>I understand that in accordance with a late Order from the U.S. War Department parts of Regiments & Companies are to be consolidating for the purpose of making these full [regiments?] at least to bring them up to the minimum standard - desiring my Regiment to fill up soon I would respectfully ask for your assistance - We number, all told, about 710 rank & file & need consequently about 1/2 Companies to bring us up to the minimum standard. If you are consolidating any of the Regts or Companies more at Camp Butler cannot you remember us and give us the requisite number to make us full? You know of what [metal?] my Regiment is composed, all Germans by birth with the exception of our Company of Swedes - can you give us some more of the same calibre. I should deem it an especial favour - I shall endeavor at all times to make my Regiment worthy of the confidence bestowed upon it - We have slept in arms for several nights back on account of the proximity of a rebel camp and their intention to drive the "dutch" from Holland, or rather from Otterville - We are prepared for a brush with them at any time and will give them a most warm reception should they not prefer to have these [illegible] again - We have [illegible] out of Price's quartermaster prisoners on yesterday and keep him in close confinement - our boys are doing well, very few of them in the ----- Hospital and only one of them has died since we left Camp Butler - he died of typhoid fever - Nothing more otherwise - Hoping to hear from you in a favorable reply.
