&lt;/p&gt;&lt;p&gt;Gov Yates I take this opertunity to drop a fiew lines to inform you about a case that I intended to inform you of three months ago but I did not perhaps you have bin informed of it before this time but if you did not I hope you will take it in to consideration John Ryan a Sargent of Co B 8th Illinois Cavadlry was comited to prison for throwing a man overboard at union dock Baltimore Md I think he did not have Justice done [Jen?] [name?] gave him up to the authoritys of Md and he was sent for 1o years   the way it hapened they was puting a lot of sesesh prisners abord of boats to send north   their was a large croud of soldiers and civiliens on the dock at the time and a man in the croud commensed to cheere for the rebs &amp;amp; old Jef   at that time their was more then fifty cryed out duck him then Sagt Ryan and several others took hold of him and shoved him overboard I was an eye witniss but I think he done his duty if

&lt;p&gt;he threw him overboard for he had taken  the oath to kill rebs but I can not say that he had more to do with drounding the man then others that had hold of him   it was close general Hospital Wests building   I was in the hospital at the time standing at an open window in the 3rd story of the building where I could se the hole of it   you can get all the partickulars by writing to dr C. W. Caden H.S.S.T. In Charge  Ryen should have bin trye a Court martial   I was a Soldier at the time  I was a private of Co G 17th regt Ind V.  I got my discharge since that time at that hospital  I believe I have wrote all that is nesessary for this time  if wish to write to write me about it Direct to Daniel D. &lt;/p&gt;&lt;p&gt;Gov Yates I take this opertunity to drop a fiew lines to inform you about a case that I intended to inform you of three months ago but I did not perhaps you have bin informed of it before this time but if you did not I hope you will take it in to consideration John Ryan a Sargent of Co B 8th Illinois Cavadlry was comited to prison for throwing a man overboard at union dock Baltimore Md I think he did not have Justice done [Jen?] [name?] gave him up to the authoritys of Md and he was sent for 1o years   the way it hapened they was puting a lot of sesesh prisners abord of boats to send north   their was a large croud of soldiers and civiliens on the dock at the time and a man in the croud commensed to cheere for the rebs &amp;amp; old Jef   at that time their was more then fifty cryed out duck him then Sagt Ryan and several others took hold of him and shoved him overboard I was an eye witniss but I think he done his duty if

&lt;p&gt;he threw him overboard for he had taken  the oath to kill rebs but I can not say that he had more to do with drounding the man then others that had hold of him   it was close general Hospital Wests building   I was in the hospital at the time standing at an open window in the 3rd story of the building where I could se the hole of it   you can get all the partickulars by writing to dr C. W. Caden H.S.S.T. In Charge  Ryen should have bin trye a Court martial   I was a Soldier at the time  I was a private of Co G 17th regt Ind V. From what I see in the Evansville Journal of the 27th 1863 Your Hon has offered ten thousand troops to repell invasion to the Sec of War. if that offer is accepted and the troops are to be raised by Voluntary Enlistment,I wish you would give me authority to raise a company in this and adjoining Counties. I have been in the Service but was discharged on account of my health at that time. My health is good now and I am anxious to serve my Country either in the Invalid Corps or in Volunteer service to repel invasion as a Commissioned Officer in either service. I think my previous Service as 1st Serg. in the Company being well acquainted with Military tactics entitles me to a more important position. The disease I was afflicted with is liable to return from exposure. But I apprehend no danger in attending to the duties of Capt. or Lieutenant. If you think proper to appoint me an Officer in Invalid Company I will respond to the call at any time. I am a friend to the administration a Member of the Union League, I am also a Master Mason and I am informed by the Trowel you delight to render M Ms all the assistance you can

Mr Rogers wrote a letter to you a few weeks ago in it was Capt J A Rice's letter also an affidavit from me requesting you to forward to the Sec of war a request to discharge from the Service A. G. R. Mattice a boy 14 years old in Co K 73 Reg Ills Vol. this boy young as he is now doing the duty of a soldier, I do hope you will use your influence to get him out of the service, he went into the State

Sir:
I beg leave to acknowledge the receipt of your communication of the 17th instant in relation to the reception of the convicts condemned by sentence of Naval General Court Martial. At the same time I received a communication from James M. Pitman Esqr. warden of the State Penitentiary, dated Joliet, Decr. 15. Mr. Pitman agrees to receive any prisoners sent there on the same terms as other prisoners heretofore received. 
I will send the prisoners, but I would like it understood that the Secretary of the Navy be informed if any action should arise out of this imprisonment or a writ of Habeus Corpus be issued for the possession of the persons of the 
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;convicts, so that the Secretary may remove them to another place.
The Law is as follows:
In any case where a naval court martial is authorized to adjudge the punishment of death it may sentence the person convicted to imprisonment for life, or for a stated term at hard labor and such sentences of imprisonment and hard labor may be carried into execution in any pension or penitentiary under the control of the United States, or the use of which shall be allowed by the legislature of a State, and persons convicted by a court martial and imprisoned in the prison or penitentiary of any State or Territory shall in all respects be subject to the same discipline and treatment and under the same control as convicts sentenced by the courts of the State or Territory in which such prison or penitentiary is situated.

&lt;/p&gt;&lt;p&gt;Sir:
&lt;/p&gt;&lt;p&gt;I beg leave to acknowledge the receipt of your communication of the 17th instant in relation to the reception of the convicts condemned by sentence of the Naval General Court Martial.  At the same time I received a communication from James M. Pitman, Esqr. warden of the State Penitentiary, dated Joliet, Decr. 15.  Mr. Pitman agrees to receive any prisoners sent there on the same terms as other prisoners heretofore received.
&lt;/p&gt;&lt;p&gt;I will send the prisoners, but I would like it understood that the Secretary of the Navy, be informed if any action should arise out of this imprisonment, or a writ of Habeus Corpus be issued for the possession of the persons of the --- convicts, so that the Secretary may remove them to another place.
&lt;/p&gt;&lt;p&gt;The Law is as follows:
&lt;/p&gt;&lt;p&gt;'In any case where a naval court martial is authorized to adjudge the punishment of death, it may sentence the person convicted to imprisonment for life, or for a stated term at hard labor, and such sentences of imprisonment and hard labor may be carried into execution in any prison or penitentiary under the control of the United States, or the use of which shall be allowed  by the legislature of a State; and persons convicted by a court martial and imprisoned in the prison or penitentiary of any State or Territory shall in all respects be subject to the same discipline and treatment and under the same control as convicts  sentenced by the courts of the State or Territory in which such prison or penitentiary is situated'.
