&lt;/p&gt;&lt;p&gt;I had not an opportunity of submitting to you fully and clearly my ideas in reference to an extra session of the Legislature, and the matter of the alleged vacancies of Seats. I am decidedly in favor of the extra session. I deem that the possible interests require it, and I beg to give you the following brief suggestions.
&lt;/p&gt;&lt;p&gt;The session should be harmonious &amp;amp; the body of that character to fully sustain the present State Administration. The best interests of the State absolutely require this.
&lt;/p&gt;&lt;p&gt;If there are no vacancies by resignation, death or removal among Republican members, the session it is presumed will be what is desired.
&lt;/p&gt;&lt;p&gt;It is said that at this time no seats of Republican members are vacant by death; none have removed from the seats of their districts, and none have resigned.
&lt;/p&gt;&lt;p&gt;It is said however that certain members have accepted offices from the United State and from this State since their election, and it is therefore required that they cannot under the Constitution hold their seats - This is not a question for the Executive; - by the Constitution
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;each house is made the judge of the qualifications of its members. No Executive can in no case judge of this, or declare seats vacant and on his own motion issue writs of election to fill vacancies on supposed disqualifications of members.
&lt;/p&gt;&lt;p&gt;As to resignations, without some express provision of law, members can only resign to the house of which they are members and before their seats can be vacated their resignation must have been accepted  See case in 4 Devereau's Rep. p. 1.
&lt;/p&gt;&lt;p&gt;Properly and strictly the Executive can take no notice of the subject of qualification or disqualification of members or vacancies of Sents. except on information from the proper house.
&lt;/p&gt;&lt;p&gt;In this case the Gov. should issue his proclaimation for convening. &amp;amp; send a copy to the usual Post Office address of each member as if nothing had happened. When the General assembly convenes and it is reported to the Gov. by either house that vacancies exist in their body from resignation, disqualification or other case, he will issue writs of election &amp;amp; cannot til then.
&lt;/p&gt;&lt;p&gt;If the Gov. should in advance, on his own motion order elections to fill supposed vacancies arising from supposed disqualification of members
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;yet each house may admit those members supposed to have become disqualified and there is no other power to reverse or correct their action, In fine it would be a usurpation of power for the Executive to adjudge members to have become disqualified and declare their seats vacant &amp;amp; proceed to order their vacancies filled.
&lt;/p&gt;&lt;p&gt;In the case of Dr Ireysse of Sangamon I am informed that his family still reside in his Dist. so he may be considered a resident still.
&lt;/p&gt;&lt;p&gt;Pardon me for presuming to make these suggestions; I hope you may give the matter of vacancy due consideration; I am satisfied it is the proper view of the case
&lt;/p&gt;&lt;p&gt;In your proclaimation. I would like if you would include the subject of Revenue in general terms as one of the subjects to be acted upon, which would give the Legislature full power oer the matter of taxation which will be the important subject of action for the session.

&lt;/p&gt;&lt;p&gt;We are a large number of soldiers belonging to Ills who have lately been transferred from Ky. Hospital to Jefferson Barracks, Mo.  Among them are several from Lake County. These men I am informed, all wish to be transferred to some Hospital in their own State. I speake particularly for those from Lake County. They wish to be transferred to Chicago and I desire to have it done if possible. Can you do us the favor to interest yourself in their behalf &amp;amp; endeavor to have the transfer made.
&lt;/p&gt;&lt;p&gt;I have not the names of all the men, or their Regt. but will try &amp;amp; get it. I wish you could move in the matter at once.

This was submitted to Post Surgeon - of Rome Ga. where said Witherell is confined with Chronic Diarrhoea, which has been upon him since May 1st The surgeon claimed to have no authority to discharge, furlough, or transfer any but wounded. I recommended him to apply to the Lieut. Colonel of his Regt. Now acting Colonel Witherell attempted to comply but was seized with a relapse &amp;amp; his disease is worse than ever, almost a certainly that he cannot recover having twice, suffered a change for the worse. His friend are anxious for his transfer to the Chicago hospital, and if consistent with your duty &amp;amp; position would be glad of your aid in this matter

&lt;/p&gt;&lt;p&gt;I telegraphed you today asking you to telegraph Gen Heintzelman asking if he would grant a furlough to Wilton Drew now in the city hospital here for 20 days. Drew is a corporal in 96th Regt. He lost  an arm at Chickamango, &amp;amp; is now waiting for his discharge papers. The surgeon thinks it will be 3 weeks before they will get  around. He is willing that he should have a furlough, but has no power himself. We thought that your request to Gen. Drew is a corporal in 96th Regt. He lost  an arm at Chickamango, &amp;amp; is now waiting for his discharge papers. The surgeon thinks it will be 3 weeks before they will get  around. He is willing that he should have a furlough, but has no power himself. We thought that your request to Gen.
