</p><p>To His Excellency Richard Yates, Governor of Illinois,
</p><p>Sir: Your petitioner, the undersigned, would respectfully represent, that during the Mormon troubles in Hancock county in this state, he had the honor of a captains commission, and commanded a company of militia from McDonough County at the time Gov. Ford visited Carthage to enforce the law against the Mormons.
</p><p>When the present war broke out, your petitioner being prompted by a desire to serve his country and not by a selfish motive to serve himself first and his second, hastened to enlist in Capt. D. P. Wells co. B, 16th Ills. Infty. He served in that Regt. until [Dec.?] 26th 1862 when he was commissioned 2nd Lieut. co. I, 57th Ills., and was at Donelson and Shiloh, and was taken prisoner at the latter place on the evening of Apr. 6th 1862. He was exchanged and again joined his Regt. on the 22nd Nov. last; but during his imprisonment in the South, two promotions were made over him.
</p><p>On the 13th of Feb. last he resigned on account of defective hearing, but which he is happy to say, is so far removed as not to disqualify him for efficient service as an officer
</p>

</p><p>This morning I advised you by mail of the death of our Judge Manierre of the Circuit Court, the public interest requires that a successor should be elected at an early day as our docket is large and litigants and attorneys are anxious to have their cases disposed of
</p><p>As I understand the Law the Gov is to order an election, and a notice is then to be given to the electors twenty days. We have a regular term of the Court commencing July 13. and by issuing the order for election immediately we will have time to give the notice, canvass the votes, and get the Commission for the Judge Elect for that Court, Will you oblige the members of the Bar, Suitors, and the Clerk, by issuing this order at an early day.
</p><p>Hoping to hear of your speedy recovery, and that you may be able to pass the batteries of Vicksburgh without harm, soon I remain Yours Truly

He has worked hard to raise his company and should not be sacrificed unless guilty. I hear it intimated that the charges are made to get his place. I hope you will see justice done him.

</p><p>Sir, I embrace the present opportunity in addressing a few lines to you in behalf of the sick and wounded Ill Soldiers here. I have been an inmate of this place since the 22nd of Jan 63. After staying here some 8 weeks I was told that if we could obtain a list of 50 unfit for duty they would transfer us to some Hospital in our own State. I obtained a list of over 70 and presented it to Surgeon B. Clark (Post Surg) who promised to give it due attention, but this is the last of it. The Ind boys were transfered

</p><p>2d A special election would be very expensive and come at a time when our friends are most active in business & would hazard a defeat at a time when to have a coperhead on that bench would be of the utmost public annoyance.
</p><p>3d The courts take a recess nearly every summer and do not pretend to do much business from first of June until October. And more especially this summer in the midst of the exciting news from the War. so that there is no pressing necessity for an

<p>election until the regular fall election. The inconvenience to suiters in that court cannot certainly be as great as the public expence and the inconvenience of a special election now.
</p><p>4th At the fall election we elect county and township officers and a judge and Clerk of the Superior Court, which will call out our friends and make a sure thing of our success, which in a special election is doubtful as the Coperheads will move heaven and earth to get a Judge in this county at this particular time.
</p><p>There may be a few files lost to the clerk of that court - but that is of very little consequence to any one but to him

<p>In view of the above reasons would it not be better to defer calling the election for the vacancy until it could be held in conjunction with the regular fall election.
