Dear Fred;

I just now received the inclosed letter from Capt Kennicott, I send it to you because I hav'nt time to write full particulars before the Springfield mail closes.

I would willingly have sacrificed every thing I possess if His Excellency could have received the petition before Col Osborne was appointed - There may be some hope yet. I do so wish that His Excellency knew the true state of things. If Col Osborne is allowed the command there is no hope for the Regiment. I have heard from several of the officers of the 39th directly, & through reliable persons, that most of the would resign if Osborne was appointed Col, The fact that the Regt is even now nearly split to pieces is evidence of its fate. Its too bad when you could have made the 39th not only the pride of Illinois but of the whole volunteer service.

I'll write again by Monday.

New York, April 16 1863

Governor,

I notice by the papers of to day that you have issued orders "under the authority of the War Department to raise a force of soldiers for the guard & protection of the State of Illinois from hostile aggression."

On the 3rd of August 1862, you addressed a letter to the Sec'y of War in which you say, "I respectfully ask that two of the "Union Repeating Guns" be furnished to each of the Regiments now forming in this state. I believe they will add greatly to the efficiency of our troops"---which letter was handed to me by Maj [Rowlands?]

The American Arms Company, whom I represent, made about 60 of these guns on the special order of the President of the United States, a part of which I personally delivered to the "Army of the Potomac" at Yorktown & the White House, & several of them were used with great effect & advantage at Williamsburg, Warwick, Gaines Mills & other

battle fields, as I have the written testimony of Major Genl. Sickles, Col. Van Wyck 56th Reg NY Vol. & other officers of high rank & intelligence to prove---& a part I delivered to the Arsenal at Washington.

Shortly after receiving your letter to the Secy of War (which is now before me) I called at the War Dept. in Washgtn & not being able to see the Sec'y I handed your letter to Mr. Watson Asst. Secr, together with a letter of the same purport from Gov. Curtin of Pennsylvania, & was contemptously told that "they paid no attention to letters from Governors of State there, for any one who has personal or political influence could get any kind of a recommendation from them."

Genl'. Wool, Fremont, & Sickles---Col. [Serrill?], Graham, all the Colonels of the Pennsylvania Regiment, & others, have made requisitions for the guns in the Arsenal at Washington, & they could not get them. But Genl. Ullmann got 8 of them last week, & has taken them with him to the South. 20 of them are now in the Arsenal, & in [govt?]

[order?], as I am informed---& paid for.

Our Company have 20 nearly completed, & a manufactory expressly for them, from which we can turn out 2 or more a week.

The Navy Dept. has ordered 4 for Admiral Porter on the Mississippi, & I am informed, (altho. I have not yet received the official order) that he has made a requisition for one for each boat of the Western flotilla.

I trust your Excellency will excuse this long communication. You know the guns. You know that two of them manned by 10 men each, will deliver as many shots in a given time, as a Regiment, & with greater range & accuracy. At this critical moment, when so much depends upon the events of the next few months every well wisher to our Country should adopt the best means for its defense & for offence. I write a statement of facts, & if your Excellency still desires the Regiments of Illinois to have the most effective arm ever known, I shall be happy & honored to hear from you.

I am sir Your obt servt

I seat myself to direct a few lines to you, which I hope will meet with favorable success, and will be received with kindness. I am well aware of your hearing all the particulars of the late great battles of Muffressboro , in which most particular the sons of Illinois done honor to their noble state, of which they are proud of. But I do not think, that anyone can imagine the trial and hardships we also had to go through after meeting with the fate of a true soldier, in being wounded and then taken prisoner by those heartless traitors of so glorious a nation of ours. But for the sake of all that is dear to us, we endured fatigue, imprisonment, cold and hunger, until we landed safe on the shore of Maryland, to call us once more; Uncle Sams boys. We are here now, applying to you and entreating your kind sympathies

and calling on you for aid, to use your influence at the War Department to call the Sons of Illinois to their own State, to let them remain there, untill they are exchanged; when they will ever be ready, once more to rally around that standard, to strike the death blow to this cursed rebellion.

I am nothing but a private, who served for nineteen months, from day to day fulfilled his duties, untill I was wounded at the late battle, from which I am not quite well yet. Allthough never before wishing to leave my regiment on a furlough, I now plead to You to send if possible, a free pass for me and a companion of mine, to Springfield. I should be very thankfull, if my wish could be granted; for I cannot at any rate serve my country at present, untill exchanged; when

I will then gladly and joyfully grasp my arms with the warcry: Union, Liberty or Death! I do sincerely hope you will have it in your power to grant my wish; if not, I wish at anyrate to soon hear your opinion about the matter, if only in a few lines; and I remain your humble and obedient

Governor of Ills.

Sir

Having served nearly a year in the 12th Regt. Missouri Volunteers, since I left Ills and had the pleasure of waiting on you at Springfield Ills., I take this opportunity of asking a favor of you, which I then foolishly declined; namely, I should like to be promoted to the Ills service, where I served as 1st Lieut in the 9th Reg in the three months service. Nearly a year ago, when at Springfield Ills, I thought the danger in Missouri was eminent, and I was determined to meet the enemy on the first occasion regardless of position. I have since,
with deep regret, found out, that it is a very embarrasing position for an officer in the Missouri service, who was born and raised in Ills. and who is justly pround of what Ills has done in this war, not only in battle, but also through the energy of its executive department, so much in contrast with Missouri. Outside of this, I always would be prefer, serving as a volunteer in my own native State, where a just executive eye sees and watches vigilantly, that justice is done to every soldier. During these eleven months I have served

in a Regt which has gained a reputation for its bravery in battle and its patient endurance of hunger and hardships and I may say that the two companies A and B from Belleville Ills. everywhere sustained their reputation for bravery and endurance surpassed by none in the Regt. As Riflemen and skirmishers this Regt. has a high reputation in the whole southwest army. I should prefer such a Regt. because I have, during a march of 1100 miles through an enemy's country, become theoretically and practically acquainted with
this branch of the service on different occasions.

Any promotion to the Ills. service whether Infantry or cavalry would be preferable to my remaining here and would be hailed with pride.

I would, however most respectfully request you, should you be kind enough to think of my promotion, not to put aside or overlook any officer more deserving or meritorious or preferred by the respective Regt.

Hoping that this meet you well and that I do not trespass to much upon your time and patience I remain your most obedient
