Since then they have buried a dashing little boy which affected seriously the Health of Mrs. Hamer who was within a few weeks of childbirth, which is always a severe ordeal for her Health, one which her friends always fear will end her days.  Under these circumstances she has given birth to her child, but such is her condition that it certainly will not do for her husband to leave, I think she would hardly survive it.  Mr Hamer I learn as sent his resignation in; and now on consultation we are really Hoping that you will fill the vacancy by the appointment of Rev Charles Atkinson, he is certainly thee

&lt;/p&gt;&lt;p&gt;Although I have my personal and official preferences, I do not Expect to Control or Exercise much influence in the appointment of his successor yet. I think I have the right to ask and do most Earnestly but respectfully ask that you will delay making any appointment until all the parties and all

&lt;p&gt;the candidates can be fully and fairly heard by you
&lt;/p&gt;&lt;p&gt;I say this much as Expression of the feelings of a large and influential portion of the bar of the district
&lt;/p&gt;&lt;p&gt;Permit me to add that, we have had two Judicial Elections for Judge and States Atty in this district since it was formed, and at Each of these Elections both the Judge and State atty have been Elected from this Co (Marshall). And now I think it but right that &amp;amp; once one out of this Co should be appointed. Especially if a good man from Woodford or Putnam Counties offer as I know will be the Case

&lt;/p&gt;&lt;p&gt;Sir  as chairman of a committee of the Board of Supervisors of this county, I write you or to the proper state officer through you for information
&lt;/p&gt;&lt;p&gt;Our board of supervisors at a special Session held last may appropriated Ten Thousand Dollars ($10,000) for "war purposes" so much of said appropriation as might be needed to the amount of Two Thousand Dollars ($2000) was specially appropriated to assist in inlisting soldiers and procuring the necessary out fit and supplies not then furnished by the State
&lt;/p&gt;&lt;p&gt;There has been some 8 or 10 companies of infantry and cavalry sent from this county.  The board of Supervisors paid $400. towards uniforms for Capt Ellis Co raised under the [Ten?] Regiment
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;they have also expended some $800 in furnishing board to recruits for a few days Each after being mustered into the companies. prior to their leaving for the state encampments vouchers for which have been signed by the Captains of the several companies
&lt;/p&gt;&lt;p&gt;we do not desire to get rid of paying any part of the $10,000 appropriation, but if we can recover back from the state so much as we have paid out for the above purposes or any part thereof, there will be so much more of our fund to be applied to its leading object, to wit, the support of the families of the volunteers from this county.

&lt;/p&gt;&lt;p&gt;Our board of supervisors at a special Session held last may appropriated Ten Thousand Dollars ($10,000) for "war purposes" so much of said appropriation as might be needed to the amount of Two Thousand Dollars ($2000) was specially appropriated to assist in inlisting soldiers and procuring the necessary out fit and supplies not then furnished by the State
&lt;/p&gt;&lt;p&gt;There has been some 8 or 10 companies of infantry and cavalry sent from this county.  The board of Supervisors paid $400. towards uniforms for Capt Ellis Co raised under the [Ten?] Regiment
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;they have also expended some $800 in furnishing board to recruits for a few days Each after being mustered into the companies. prior to their leaving for the state encampments vouchers for which have been signed by the Captains of the several companies
&lt;/p&gt;&lt;p&gt;we do not desire to get rid of paying any part of the $10,000 appropriation, but if we can recover back from the state so much as we have paid out for the above purposes or any part thereof, there will be so much more of our fund to be applied to its leading object, to wit, the support of the families of the volunteers from this county.

As Dr Burke the Surgeon of this Hospital was sick, he requested me to take charge of it for the present, to which I assented, in hopes a Regiment might offer. Though Dr Burke was recieving 280 dolls pr month as Brigade Surgeon, I can only get 100 for the same services.  As no Regiment offers here, may I ask of you to give me a Regiment if in your power?  I have

&lt;p&gt;refrained from troubling your Excellency, because of the press of business demanding your attention, and would not do so now did I know any other course to pursue. &lt;/p&gt;&lt;p&gt;Supplies forwarded by particular States for their volunteers in the service of the United States, will be turned over to the proper staff departments of the Army, and issued, according to law and regulations, to the troops of the States for which they were specially intended.  But as such supplies will eventually be charged to the United States, any that may remain in excess of regulation allowances, may, when so directed by the General Commanding, be issued to any other troops in the service of the United States standing in need of them.

&lt;/p&gt;&lt;p&gt;I beg leave to call your attention to a matter which is of interest to me and which you alone can fully comprehend and settle.
&lt;/p&gt;&lt;p&gt;I had a Commission as Captain in the 12th Regt Ills Vols, dated April 25/61. The regiment was at first organized and mustered in as a three months regiment and was mustered out of the service Aug 1. at Cairo, their term of enlistment having expired. On the same day (Aug 1st) the regt was mustered in again for the term of "3 years unless sooner discharged", Previous to our being mustered in the second time, elections were held, by order of the Colonel, for Company officers, in some companies the officers were changed but I was re-elected as was, also, my two Lieutenants.
&lt;/p&gt;&lt;p&gt;In the first organization I was the senior Captain, it was partly decided by lot and I won it. In the second organization I am also the senior Captain by having had a previous commission of oldest date.
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;At the time of the new election for Company officers there was no election held for Field Officers, that was deferred until Sept 24, nearly two months after we were mustered in the second time. The old Field officers retained their offices: - viz John McArthur Col. Augustus L Chetlain Lt Col and William D Williams Major.
&lt;/p&gt;&lt;p&gt;On the 23d Sept Col McArthur ordered an election for Field officers, but Maj Williams protested against an election for Major as there was no vacancy of that office, he was, however, subsequently: - Sept 25th - prevailed upon to withdraw his protest and then resigned, his resignation was accepted by Maj Genl Fremont to take effect Oct 1st '61. At the election spoken of Caps A. C. Ducut received 20 votes, S R Metmore (regimt Quarter Master) received 3 votes and Maj W D Williams received 2 votes. I received 3 votes. - there was only 28 votes cast in all.
&lt;/p&gt;&lt;p&gt;The law in regard to filling vacancies in the Volunteer regts is not very clearly understood by us soldiers, some think they are to be filled by elections. - others are of opinion that they are to be filled by your appointments and, still others, are of opinion that they are to be filled by promotions from seniority. The latter is the manner directed by the Army Regulations and we are considered in all respects as belonging to the U. S. Army.
&lt;/p&gt;&lt;p&gt;The position of the Field officers in our regt
&lt;/p&gt;
&lt;hr /&gt;
&lt;p&gt;was peculiar to the 1st Brigade along. From the fact that they were mustered out of the service Aug 1st did it make those positions such as were to be filled by yourself as original appointments? In the election for our Field officers held Sept 24th there was no vacancy in the Majority as, the then occupant, averred, he tendered his resignation Sept 25. and it took effect Oct 1st, the election was, therefore, one day or six days too early.
&lt;/p&gt;&lt;p&gt;The inferences to follow from my statements here made are. - If the offices are elective, and if the election of Sept 24th was properly held, Capt A. C. Ducat is entitled to the Majority, he had 20 out of 28 votes. - If the offices are to be filled from promotions by seniority it belongs to me. - Capt Ducat was not a Captain until we were mustered in the second time. - If the positions were to have been filled as original appointments, they have never yet been filled.
&lt;/p&gt;&lt;p&gt;I believe I was among the first to apply to your Excellency for a Majority, I applied when the cloud of war was no bigger than a man's hand. I applied again in July last, after the war had become a fixed fact. And now I respectfully ask that the commission be given to me if you think it belongs to me and not otherwise. All the statements here made as facts, I make upon honor.
