Gov. Yates
It was said by Mr. Webster several years ago, that "there are no Sundays in revolutionary times", and so I have not hesitancy in dating a letter on Sunday. Capt. D.O. Kitchison of this city proposes to see you, and claim position in this Regiment, and he has liberally supplied his Company since the enlistment of his Company, he having furnished board to his men, and continually drilled them since their enlistment. We have no choice to make between the Company of Capt. Kitchison, and that of Capt. Ellis - they are all good men and true, and we hope they may be both accepted; but if it is true, as would seem from the papers, that Kitchison's Company was first offered, it would seem to be but justice that that it should have its proper position of priority. You will of course examine this question of priority, and we will refer you to the
dispatches sent from here & the answers returned form the Adjutant General's Office, and also to the letters from Capt. Hurlbut which will be presented with this.
Respectfully &c

Capt Kitchison's Company war officers have been in drills for about 12 days and if priority of organization over tender are a basis of choice will feel justly against and the effect will be [illegible] discouraging to a band of noble men my own if any other co is substituted.
Respectfully Wm Lyman
