Sir

This will be handed you by Mr. W. G. Gardener, who asks that the disability resting upon him in consequence of being dismissed the Service in 1862 may be removed. I knew Mr. Gardner and some of the circumstances which caused his dismissal, and have reason to believe that he was unjustly dealt with. Even after Mr. G was dismissed he remained in the Service for some six months without pay and took part in the battle of Pea Ridge and rendered efficient service.

He desires again to enter the service, and in order to do so the


disability caused by his dismissal would have to be removed. I am satisfied that Mr. G.'s is one of those cases which was hurried through a court martial without proper thought or consideration.

In aiding him I believe a simple act of justice would be done a good officer.
