Dear Rives,
The papers from the 79th just received are such as to satisfy me beyond doubt of two points, first that Henry can have no peace in the Regiment, and second that nothing short of the appointment of Maj. Buckner Colonel will give satisfaction. I shall not do as the officers and Generals request, revoke Henry's commission, but I am pretty well satisfied they will have him removed. Under the circumstances, you will, I believe, agree with me that it would be better for Henry to
withdraw. If you do not think so, but prefer his running his chances then let it be so as I can procure authority at Washington directing him to be acknowledged until he is removed.
I shall appoint Major Buckner to the Colonelcy because no other recourse is left to me. Buckner promises me that if I will do so he will recognize Henry as Lieut Colonel under his commission.
I have thus stated the whole case to you, and I desire your answer immediately. I have gone as far to serve you in this matter as you as my friend could ask. I desire you to write immediately as I shall give Maj Buckner his commission before he leaves for his Regiment. I hope you will see him and talk the matter over with him.
Your friend,
Richd Yates
