I beg to address you on behalf of those officers of the 24th Regt. Ill Vols (Col Hecker) who have resigned their position in said Regiment and whose resignation was accepted by “Spec Order 101” issued Nov 11, 1861 by Brig Gen Sherman Commander of the Dept of the Cumberland.
The circumstances under which said officers tendered their resignations are very peculiar; a Court Martial to investigate the charges preferred against Col Hecker being declined, they could not with justice to the public service or themselves retain their position and were really compelled by the best of reasons to tender their resignations.
The circumstances attending the resignation of said officers are such that, in my opinion, the rule of the Department
prohibiting officers, who have resigned from being recommissioned, should be set aside in this particular instance.
The officers above mentioned, are worthy men and good soldiers, some of them have seen service abroad an are all anxious to serve the country
Some of the officers could at once obtain military appointments and I would be greatly pleased to have you comply with my urgent request, viz to set aside in this particular case the general rule and to grant permits to the gentlemen in question to enter the army in an official capacity, in case they or either of them can obtain the same.
