In my interview with you yesterday, after saying that you had put down my name for an appointment, you inquired if I had Kinney's approval or consent: I replied - yes - that I had presented Capt. Kinney's and Capt. Greer's recommendation to you on my first visit. Since my return I have had a conversation with Col. Kinney, who says that he wrote that letter as Captain of a company, and tho' as willing now as then that I should have a place, that as Colonel he proposes to leave the selection of Surgeons to the Captains of the Regiment: He does this, he says, to avoid any chance of dissatisfaction. I think it proper to make this explanation immediately. I had no communication on this subject with Col. Kinney from the date of his letter untill to day. I therefore release
you from any obligation arising from Col. Kinney's implied approval or consent; and will be content to take my chances with other candidates, who have however in the mean time canvassed the whole ground. With my apology for troubling you so much

Refers to interview had Aug 28th 62. Says that in consultation with Col. Kinney the Col. says that he will leave the selection of surgeon to the Capt of his reg't and the writer wishes to release Gov. from any oblig. on acct of Col Kinneys implied promise & will take his chances with the rest of applicants.
