SS.
Milden Kitchell, co-defendant with Elizabeth Kitchell, in a certain action of Trespass on the case for words spoken pending in the Circuit of the County aforesaid wherein Mary Ann Jacobus, is plaintiff, being first duly sworn, states on oath that said plaintiff is wholly unable to pay the costs in this suit as affiant verily believes; that affiant has known the plantiff for a considerable length of time, and has not known of her having any property whatever, beyond her wearing apparel.
