Dear Sir:
Owing to my absence from the Capitol, your letter of the 1st inst. was not answered before. I have examined the papers in the case of Crabtree and find that the Warden of the Penitentiary refuses to recommend his pardon and says that his conduct while in the Institution has not been good. I have adopted it as an inflexible rule to require in all cases in addition to the recommendation of the Judge and the States attorney a certificate of good conduct from the Warden.
The officers of the Penitentiary all agree that the knowledge of this rule tends to a stricter observance of the prison discipline and has a very beneficial effect upon the
conduct of the convicts.
My predecessors have inaugurated this practice and I have so far followed it and as much as I would like to oblige you, and follow my own feelings, I do not think it consistent with my sense of duty to grant a pardon in this case.
