Governor Yates;
In reply to your note of this P.M. I would state that the 110th Regiment has been consolidated into four companies. As therefore the regimint is much below one half the maximum number it is doubtful whether, as the battalion has a Lieutenant Colonel, it is also entitled to a Major.
A short time since Lt Col Topping was here and requested that no appointment of Major should be made until he returns to his regiment and was heard from. This I promised him and he agreed to talk matters over with General Palmer who had taken considerable interest in the regiment
An appointment at this time I should regard therefore a violation of my promise to Lieut Col Topping.
I do not know either of the Captains
and have no opinion of their merits. Capt Cantrell is the Senior Captain and if it is entitled to a Major he should be promoted after hearing from Lt Col Topping.
