I request leave, respectfully to withdraw my resignation as Colonel of the 130th ills. Vols (Infty) which was sent in at New Iberia La. on the 5th Decr. ult, and accepted on the day by Major Gen. W.B. Franklin
I make this request by desire of Gov. Yates of this state, and respectfully refer to the President on the propriety of granting the same

War Depart. adjutant Generals office April 6. 1864 Respectfully returned. It is presumed that this was designed as an application for removal of disability - by resignation and if so, if should have emanated from the Governor of the State. Actions for the revokal of special orders, accepting the resignation of officers, when considerable time has elapsed, as in the present case, cannot under the rules of the Departmental be taken.
