Adjutant General,
Sir,
Business calls me home to day; and therefore I shall perhaps not be here when the Governor, shall determine upon the record and proceedings of the Court Martial, in the case of Col Up De Graff. If the Governor shall find that the Court Martial convicted Col Up De Graff, and shall be inclined to approve their finding, I should be Exceedingly glad to have an interview with him before he shall finally determine the matter, in as much as I think the proceedings of the Court Martial were so irregular, as to render the same void. I would therefore
like to have the privilege of presenting to his Excellency my view of the law. And also to present to him a petition from the men of the 5th Cavalry Reg. for the restoration of their Col to his command. I believe the men of the Regiment will almost unanimously sign such a petition in case of the Cols Conviction. This may be asking too much of his Excellency, but I feel that Justice to Col Up De Graffe, And my duty in the premises may require that it should be done. Will you therefore have the final disposition of the case postponed until I can return; say one or two days. Col Up De Graff will tellegraph to me in case this favor can be granted. I am Sir very
Respectfully, A B Burns
